Acceptable Use Policy

A Bust is a likeness of a real person. To protect the people depicted in the photographs you upload — and to protect you — these are the ground rules for what we can and cannot make.

02Age & minors

You must be at least 18 (or the age of majority where you live) to place an order.

If a depicted person is a minor, you must be their parent or legal guardian and you must provide verifiable parental consent at the point of upload. We reserve the right to verify your status (for example, by asking for an ID-confirmation video call) before producing a Bust of a child.

We do not knowingly accept photographs of children under 13 from anyone other than a verifiable parent or legal guardian, in line with the United States Children’s Online Privacy Protection Act (COPPA).

03Public figures & celebrities

You may not submit photographs of public figures, celebrities, athletes, politicians, fictional characters, or other persons whose likeness is protected by right-of-publicity laws — unless you can document express written authorisation from that person or their authorised representative.

Right-of-publicity laws vary by jurisdiction and may include post-mortem protections (for example, California Civil Code § 3344.1, Indiana Code § 32-36-1, New York Civil Rights Law §§ 50-f, and Tennessee’s Personal Rights Protection Act).

If we suspect a submission depicts a public figure without authorisation we will pause the order, contact you, and refund the order if we cannot proceed.

04Deceased persons

Memorial Busts are some of the most meaningful work we do. To honour the person depicted, we ask that you have the consent of the surviving family — or, where relevant, the estate — before placing the order. Where post-mortem publicity rights apply (see above), authorisation from the rights-holder is required.

07Biometric awareness

Generating your Bust involves computing a representation of facial geometry from your photographs. In some jurisdictions this is treated as biometric information and is subject to specific consent and retention rules — including the Illinois Biometric Information Privacy Act (740 ILCS 14/), the Texas Capture or Use of Biometric Identifiers Act, and Article 9 of the EU GDPR. Our retention and destruction commitments and the BIPA-specific written consent disclosure live in the Privacy Policy.

08How we enforce this

09Reporting an unauthorised likeness

If you believe a Bust has been ordered using your likeness without your authorisation, please email legal@jagtarstudio.com with:

  1. A clear description of the likeness used and how you became aware of it;
  2. Your contact details and a way to verify your identity (for example, a current photograph alongside government-issued ID, which we will hold in confidence);
  3. If known, the order date, customer name, or any other identifying detail.

We will halt production immediately upon a credible report and complete an investigation within 7 business days.
