Acceptable Use Policy
A Bust is a likeness of a real person. To protect the people depicted in the photographs you upload — and to protect you — these are the ground rules for what we can and cannot make.
01Identity & consent
By submitting a photograph you represent and warrant that at least one of the following is true:
- You are the person depicted in the photograph; or
- You have obtained the express, informed consent of every identifiable person depicted to use their likeness for the creation of a sculpture.
Consent must be specific to a sculpture commissioned from Jagtar Studio. A general permission to share photos online is not enough.
02Age & minors
You must be at least 18 (or the age of majority where you live) to place an order.
If a depicted person is a minor, you must be their parent or legal guardian and you must provide verifiable parental consent at the point of upload. We reserve the right to verify your status (for example, by asking for an ID-confirmation video call) before producing a Bust of a child.
We do not knowingly accept photographs of children under 13 from anyone other than a verifiable parent or legal guardian, in line with the United States Children’s Online Privacy Protection Act (COPPA).
03Public figures & celebrities
You may not submit photographs of public figures, celebrities, athletes, politicians, fictional characters, or other persons whose likeness is protected by right-of-publicity laws — unless you can document express written authorisation from that person or their authorised representative.
Right-of-publicity laws vary by jurisdiction and may include post-mortem protections (for example, California Civil Code § 3344.1, Indiana Code § 32-36-1, New York Civil Rights Law §§ 50-f, and Tennessee’s Personal Rights Protection Act).
If we suspect a submission depicts a public figure without authorisation we will pause the order, contact you, and refund the order if we cannot proceed.
04Deceased persons
Memorial Busts are some of the most meaningful work we do. To honour the person depicted, we ask that you have the consent of the surviving family — or, where relevant, the estate — before placing the order. Where post-mortem publicity rights apply (see above), authorisation from the rights-holder is required.
05Prohibited content
You may not submit photographs that:
- Are sexually explicit, nude, intimate, or constitute non-consensual intimate imagery;
- Sexualise a minor in any way (we will report any such content to law enforcement);
- Promote violence, terrorism, hate against protected classes, or extremist imagery;
- Defame, harass, or threaten a real person — including a likeness intended to mock or intimidate;
- Infringe any copyright, trademark, design right or other intellectual-property right;
- Reproduce existing copyrighted artwork or sculpture; or
- Otherwise violate applicable law.
06Copyright & photographer rights
Photographs are copyright works belonging to whoever took them. If a photograph was taken by a professional or studio photographer, you must have a licence sufficient to permit a derivative work to be made from it (a typical wedding photographer licence does not include this — please check). If we are unsure, we may pause the order and ask for written confirmation.
07Biometric awareness
Generating your Bust involves computing a representation of facial geometry from your photographs. In some jurisdictions this is treated as biometric information and is subject to specific consent and retention rules — including the Illinois Biometric Information Privacy Act (740 ILCS 14/), the Texas Capture or Use of Biometric Identifiers Act, and Article 9 of the EU GDPR. Our retention and destruction commitments and the BIPA-specific written consent disclosure live in the Privacy Policy.
08How we enforce this
- Every uploaded photograph is checked against the Acceptable Use Policy by our reviewers — and, before the order is approved, by an automated content check.
- If we believe a submission violates this policy we will pause the order and contact you. If the issue cannot be resolved, we cancel the order and issue a full refund.
- We may report unlawful submissions to law-enforcement authorities and preserve evidence as required by law.
- Repeat violations may result in a permanent block on future orders from the customer, household, address or payment method involved.
09Reporting an unauthorised likeness
If you believe a Bust has been ordered using your likeness without your authorisation, please email legal@jagtarstudio.com with:
- A clear description of the likeness used and how you became aware of it;
- Your contact details and a way to verify your identity (for example, a current photograph alongside government-issued ID, which we will hold in confidence);
- If known, the order date, customer name, or any other identifying detail.
We will halt production immediately upon a credible report and complete an investigation within 7 business days.
