01Acceptance & eligibility

By placing an order, ticking the consent boxes at checkout, or otherwise using our service, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy and Acceptable Use Policy, which form part of these Terms.

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a contract. If you are ordering on behalf of a company, you represent that you are authorised to bind it.

02What you’re buying

A Bust is a bare-resin sculpture, 3D-printed and hand-cleaned from two photographs you submit, supplied with an integrated printed plinth (printed as one piece with the bust). The Bust is shipped in protective packaging. Each Bust is supplied unpainted in its natural resin finish — no paint or pigmentation is applied by us. Each Bust is made to order from your photographs and is therefore a “good made to your specifications and clearly personalised.”

We sell directly to consumers; we are not a wholesale or trade supplier. Photographs of finished Busts on our site are illustrative — your Bust will be unique and crafted from your photographs.

03AI-assisted output

The fidelity of your Bust depends on the lighting, resolution, angle and clarity of the photographs you supply. We may, but are not obligated to, request replacement photographs. We are not liable for output limitations caused by source-photo quality.

Each Bust is hand-cleaned and finished in its bare resin form. Minor variations in surface texture, seam lines, base finish and resin colour tone are characteristics of a 3D-printed handmade product and not defects.

04Ordering & payment

Prices are displayed at checkout in the currency of your region. We currently price our standard Bust at $49 with free worldwide shipping; full pricing details and any applicable taxes appear before you confirm payment.

Payment is processed by Stripe. We do not see, store or have access to your card number. If your payment is declined we may decline or cancel your order.

We reserve the right to refuse or cancel any order at our sole discretion — for example because of a suspected violation of the Acceptable Use Policy, suspected fraud, or because we cannot manufacture the order to a quality we are willing to ship. If we cancel, we will refund any amount paid in full.

05Production & delivery times

Production takes approximately 5 working days; shipping takes approximately 7–10 working days. Total estimated delivery is approximately 12–15 working days from when we have received and approved your photographs. These are estimates, not contractual deadlines.

If we have not shipped your order within 30 days of payment confirmation, you may cancel for a full refund (this preserves your rights under the US FTC Mail-Order Rule, the Ontario Consumer Protection Act, the UK Consumer Rights Act, the EU Consumer Rights Directive, and the Australian Consumer Law).

06Custom-made cancellation

Each Bust is made to your specifications and is clearly personalised. Once production has commenced, the 14-day right of withdrawal under Article 16(c) of EU Directive 2011/83, regulation 28(1)(b) of the UK Consumer Contracts Regulations 2013, and equivalent distance-selling rules does not apply. We disclose this to you at checkout.

Pre-production cancellation window. You may cancel for a full refund any time before we begin AI generation or 3D modelling — typically within 24 hours of placing the order. Email hello@jagtarstudio.com with your order number.

Nothing in this section limits your statutory rights if your Bust is faulty, not as described, or otherwise non-conforming. See our Refund Policy.

07Your photographs & content

Licence you grant us

By uploading photographs and any other material (collectively “Customer Content”) you grant Jagtar Studio a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, modify, adapt, process through the third-party AI services listed in our Privacy Policy, create derivative works (including 3D meshes, textures and printable files) and otherwise use Customer Content solely to fulfil your order, provide customer support and comply with law. This licence terminates 120 days after delivery, except for backups retained for legal, fraud and tax purposes.

Marketing — opt-in only

We will not use your photographs, your name, your Bust or images of your Bust in marketing, social media, advertising or our portfolio without your separate, express, opt-in consent, which you may give or withhold at checkout and may withdraw at any time.

Your warranties

You represent and warrant that:

• You are the person depicted in the photographs, or you have obtained the express, informed consent of every identifiable person depicted (and, if any depicted person is a minor, you are their parent or legal guardian).
• You own or have all necessary rights in the photographs (including any copyright held by a photographer).
• The Customer Content does not infringe any third party’s intellectual-property, privacy, publicity or other rights, and does not violate any law.

Ownership of the model and derivative files

You own the physical Bust delivered to you. You do not acquire any rights in the underlying digital 3D model, AI prompts, generation parameters, print files or other derivative works created by us or our AI suppliers. We retain all right, title and interest in those works. We may retain non-identifiable technical artefacts (e.g. anonymised mesh-cleanup techniques) for service improvement.

08Prohibited submissions

You may not submit photographs or other Customer Content depicting:

• Any person who has not consented to having their likeness reproduced as a sculpture.
• A minor (under 18, or the age of majority where you live) unless you are their parent or legal guardian and provide consent on their behalf.
• Public figures, celebrities, athletes, politicians or other persons whose likeness is protected by right-of-publicity law, unless that person is you or you can document express written consent.
• A deceased person where post-mortem publicity rights apply, without authorisation from the estate.
• Sexually explicit, nude, intimate or non-consensual intimate imagery; weapons used unlawfully; controlled substances; extremist imagery; defamatory or harassing content; or copyrighted artwork or sculptures.

We may refuse, cancel or terminate any order we reasonably believe violates this section, with a full refund and without further obligation. Where appropriate we may report unlawful submissions to law enforcement. The full Acceptable Use Policy is part of these Terms.

09Refunds & replacements

We offer a voluntary Happiness Guarantee: if you are unhappy with your Bust for any reason, contact us within 30 days of delivery and we will, at your choice, remake the Bust, issue store credit for the full purchase price, or refund you in full. Damage in shipping, lost shipments and pre-production cancellations are also covered.

Nothing in these Terms limits your non-excludable statutory rights, including under the UK Consumer Rights Act 2015, EU Directive 2019/771, the Australian Consumer Law, or the Ontario Consumer Protection Act and Sale of Goods Act. Full detail is in our Refund Policy.

10Workmanship warranty

We warrant that, on delivery, your Bust will be free from material manufacturing defects. If a defect appears within 30 days of delivery, contact us at hello@jagtarstudio.com with photographs and we will repair, replace or refund at our discretion.

Except for this Limited Workmanship Warranty and your non-excludable statutory rights, products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing or usage of trade. We do not warrant that the Bust will be a perfect likeness of any person.

This disclaimer does not apply to the extent prohibited by your local consumer-protection law. Consumers in Ontario, the UK, the EU, the EEA, Switzerland and Australia retain all non-excludable statutory rights.

11Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or related to your purchase, the products or these Terms is limited to the amount you paid for the order giving rise to the claim (typically $49 plus shipping and tax). We are not liable for indirect, incidental, consequential, special, exemplary or punitive damages, lost profits or loss of data.

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot lawfully be limited or excluded under your local consumer-protection law (including the UK Consumer Rights Act 2015, the Australian Consumer Law, or the Ontario Consumer Protection Act); or (d) gross negligence or wilful misconduct where local law prohibits exclusion.

12Indemnification

You agree to defend, indemnify and hold Jagtar Studio harmless from any third-party claim arising out of Customer Content you submitted in violation of these Terms — including right-of-publicity, defamation, copyright or privacy claims — and from your other breach of these Terms. We will tender defence to you and you will retain reasonable counsel acceptable to us.

13Intellectual property

“Jagtar Studio”, our logos, designs, photographs, written content and the look-and-feel of jagtarstudio.com are owned by us or licensed to us. You may not copy, modify, distribute or use them without our written permission, except that you may display photographs of your own Bust on personal social-media accounts with credit to @jagtarstudio or a link to our website.

14Privacy

Your use of our service is governed by our Privacy Policy, which is part of these Terms. The Privacy Policy explains what we collect, how we use it, who else processes it, and how to exercise your rights.

15Disputes

Informal resolution first

Before filing any formal claim you agree to contact us at legal@jagtarstudio.com and give us 30 days to attempt a good-faith resolution.

Consumers in Canada, the UK, the EU, the EEA, Switzerland and Australia

Disputes will be resolved in the courts of your country (or, in Canada, your province) of habitual residence, applying mandatory consumer-protection laws of your home jurisdiction. Nothing in these Terms requires you to arbitrate or waive class-action rights. Pre-dispute mandatory arbitration and class-action waivers are not enforceable against consumers in Ontario (CPA s. 7(2); Seidel v. TELUS) or the EU/UK and we do not assert them against you. EU consumers may also use the European Commission’s Online Dispute Resolution platform.

US consumers — arbitration & class waiver

Except for small-claims actions and disputes under $1,000, disputes between a US-resident customer and Jagtar Studio will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, seated in Toronto, Ontario or remotely at your election. You and Jagtar Studio each waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing legal@jagtarstudio.com within 30 days of your first purchase.

16Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Subject to the dispute-resolution section above and any non-excludable consumer right to sue in your home court, the courts of Toronto, Ontario have exclusive jurisdiction.

If you are a consumer habitually resident in the EU, the EEA, the UK, Switzerland or Australia, this choice of law does not deprive you of the protection of any provision of the law of your country of habitual residence that cannot be derogated from by agreement (in particular EU Regulation 593/2008 (Rome I) Art. 6 and the Australian Consumer Law).

17Changes to these terms

We may update these Terms from time to time. Material changes are posted on this page and emailed to active customers at least 30 days before they take effect. Changes apply prospectively only — the Terms in force when you placed your order continue to govern that order.

18General

Force majeure. We are not liable for delay or failure to perform caused by events outside our reasonable control (carrier strikes, natural disasters, power outages, government action). We will keep you informed and, where production is materially delayed, offer you the option to cancel for a full refund.

Severability. If any provision is held unenforceable, the remaining provisions remain in full force.

No waiver. Failure to enforce a right is not a waiver of that right.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a corporate transaction.

Entire agreement. These Terms together with the Privacy Policy, Refund Policy, Shipping Policy, Cookie Policy and Acceptable Use Policy are the entire agreement between you and us.
